Companies, as well as employees, are looking for more flexibility in work. Telework can provide
an answer to their expectations. It offers spatio-temporal flexibility, but however requires rethinking
the organization of work. To frame teleworking, it is essential to establish rules to protect both the
interests of companies and employees. However, the current legal framework is insufficient both in
North America and within the European Union. We present the European and North-American legal
context for telework, to determine its impact on flexibilization and organization of work within
