Abstract

In their advice of 27 January, the French National Ethics Committee, when examining the issue of euthanasia, invite us to admit of an exception in the context of a “binding commitment” to “face circumstances together”, an essential element in an ethical approach to death. And in order to lead us to “assume” the paradox of a transgression which should be considered as “untransgressable”, the Committee suggest modifying our criminal procedure by having an “interdisciplinary commission” appreciate before the judgment the validity of the motives that have inspired this act of transgression thus transformed into a binding commitment.
