SEX CHANGE IN TUNISIA: EVOLUTION OF JURISPRUDENCE

Background: Transsexualism, in Tunisia, remains a subject for debate, given the weight of religious and social factors. The objectives of ourstudy are to discuss the different medico-legal aspects raised by the subject of sex change in Tunisia, through the study of 3 cases.
Cases: The first two cases concern a transsexual woman and a man who have undergone surgery for sex change abroad and have requested a change in civil status in Tunisia. The judge refused their requests. The third case is that of a transsexual woman who underwent sexual reassignment surgery abroad and then asked to have her civil status changed in Tunisia. The judge agreed to change the civil status of the applicant to male and to change her first name.
Conclusion: The study of these three cases shows the evolution of Tunisian jurisprudence in favor of respecting the rights of transsexual people. Doctors, judges and men of religion must work side by side to produce beneficial results for transgender people.
