Abstract

Based on the current situation of the application of artificial intelligence in the medicalfield, this paper attempts to reflect on the relationship betweenlaw and technology. On the one hand, the development of artificial intelligence technology has greatlypromoted the realization of health; on the other hand, from the perspective of law, the high-risk nature of the medical field has intensified after the introduction of Artificial intelligence, which has caused value conflicts and doctor-patient contradictions. The legislative and administrative norms in China’slegal system are not enough to regulate this field. The introduction of soft law will complement the implementation of the existing hard law, increase the flexibility of the legal system, and not only promote technology research and development and industrial interests, but also balance national governance, social development and individual rights and interests.
