Abstract

This article aims to describe the way in which sexuality is assessed during the criminal examination of a respondent, more particularly when the latter is indicted for acts of sexual offense, in a context where it is difficult or even impossible to scientifically describe normal sexual behavior, especially in terms of sexual orientation or frequency of sexual intercourse. We
will see in this article how psychiatry and sexology try to define pathological sexual behaviors, that is to say, which constitute potentially a disorder, possibly liable to criminal prosecution. At the end of the article, we will address the issue of psychiatric care for perpetrators of a sexual offense, which most often falls within the overall framework of the order of care and socio-judicial monitoring.
