THE PROTECTION OF THE ELDERLY BY THE ADMINISTRATIVE JUDGE

Abstract

Old age is barely a legal concept as it does not involve specific rights for the elder. However, when it accompanies concepts such as the termination of working period in the lifetime or the incapacitation due to the deficiency related to the old age, the elder seem to get a specific status. As the latter does not lead to a general category of vulnerable individuals, it nonetheless struggles with enjoying the protection of French administrative judge, given the lack of objective criterion established by the legislator.
