As the Court pointed out, “the present case has ...
for object an aspect of the problems which can
meet different trans people
of those that the Court has had the opportunity to consider until
present. It raises the question of the requirements
prerequisites for the gender reassignment process
be imposed on transsexuals, and the compliance of
these in Article 8 of the Convention "(para. 62).
In this regard, “the Court considers that the refusal which was
initially opposed to the applicant had undeniably
repercussions on their right to gender identity and
to personal development, a fundamental aspect of
his right to respect for his private life. This refusal has thus
constituted an interference with the right of the person concerned
respect for his private life, within the meaning of Article 8 § 1 of the
Convention
