Abstract

The incapacity dispute Court is a first degree jurisdiction
which rules in particular in disputes relating to the contests of the rate of partial permanent disability given to
the victims of work accidents or occupational diseases.
In principal, the rules governing the intervention of the
lawyer in this dispute are similar to those applicable in
the procedures before the other social security jurisdictions.
Yet in practice, the place accorded to the lawyer is diminished.
Indeed, when it comes to the procedure of a hearing or to
the drafting of the judgments handed down by the
Jurisdiction, the actual practices tend to reduce or limit
the opportunity for the litigant to call in a defense counsel, or at the very least to diminish the impact of the diligences of his lawyer
