Will 2017 be the year of finalization of the application of
the “Jardé” Act ? After a busy year in 2016, which has seen
an ordinance enforcing the application of the Law and,
surprisingly, an implementing decree and a precision order,
the year 2017 should have witnessed the full and complete
application of the Act five years after its promulgation.
However, an amending decree, another order and a new
decree regulating biological samples, were enacted by the
government. The proliferation of legal texts applicable to
health research, including in 2018, encourages us to accuratly interpret them to not forget the principles initially
contained in the Act.
