Abstract

Since December 1, 1984, bodily damage caused to third parties by moving vehicles has been compensated
according to the dahir brought into law on October 2, 1984. The main innovation consists in the limitations of the
discretional power of the judge in the valuation of the allowances. The role of the medical expert is essential in
the proceedings of allowances of highway accidents victims. While respecting certain rules of expert ethics relating
to the contradictory character of the expertise, he must give a decision based on several patrimonial and extra
patrimonial injuries. Unfortunately, the medical staff is often not well informed about the limitation of this dahir.
This has an obvious effect on the quality of expertise as well as on the quality of the legal compensation of the
bodily damage
