Abstract

Medical liability in case of delayed breast cancer diagnosis is based on fault. Delayed diagnosis may give rise to
a specific damage because patients lost opportunity of having suitable and early treatment. Thereby, patients may
suffer from a much more aggressive treatment and even die. Several practioners (GP, oncologist, gynecologist,
radiologist…) may be held liable only if each of them has been negligent. When several physicians are liable for
damage, severity of the penalties is commensurate with the seriousness of the misconduct. Preventing risk of civil
lawsuit is possible for physicians
