Abstract

The evolution of medical responsibility has been increasing over the last two decades with new legal regulation.
Withing this context, the issue of our research is organized on two levels.
In the first part, the current framework of penal responsibility of healthcare practitioners is examined.
In the second part, fundamental research and discussion are conducted regarding the conception of penal
immunity to envision for healthcare practitioners. Its justification, its interest and its limits are outlined.
Possible ideas for practical solutions are put forth in order to find a fair compromise, both for the legal and
medical worlds
