Abstract

Transsexualism and wider gender identity is a still much
debated matter in France, partly on account of a gap in
the law. The Court of Cassation refuses to recognize the
concept of gender identity. It also continues to be very
strong against transgender people about the conditions of
sex change in marital status, going against, on the one
hand, liberal judicial precedents developed by the trial
court, and, on the other, against various international
recommendations. The national Advisory Committee on
Human rights offers a counterpoint legislative reform in
the direction of greater protection of the rights of
transgender people.
