THE REACH REGULATION ON CHEMICALS IN EUROPE: TO AN AMBITIOUS AND PROMISING REGULATION TO A COMPLICATED AND LIMITED APPLICATION

The entry into force of the regulation n°1907/2006 on
June 1st 2007, concerning the registration, evaluation
and authorisation of chemicals (said “REACH”), had
been often described, correctly, as the most ambitious
legislation in the world in the field of chemical substances. However, after seven years of entry into force, the
results are uncertain. The regulation seems, in practice, to
suffer from an insufficient application by industries who
are the direct addressees of the procedures that it establishes. As a matter of fact, the compliance of the companies to these regulatory measures is not as easy as it seems
and this, partly because of the difficulty to clearly define
the scope that covers, but also by the significant
constraints resulting from the application of the regulation for the companies involved – Back on this regulation
as promising as complex in its implementation.
