MEDICAL GENETICS FACED TO THE FRENCH LAW OF REFORM OF THE BIOLOGY

Abstract

In its genesis and its application the law of reform of medical biology of 2013 came to change and even to question the exercise of medical genetics. The paradox is that
without even be referenced, the reform is inspired by the
essential principles of the constitution of the specialty of
medical genetics. While it that had just reduced a large
part of its essence and significantly hampered its practice
fields. Analysis of its construction allows identifying approximate foundations at both technical but also moral
levels. It is admitted even by the Executive and Legislative Authorities that it brings some risk to loose expertise,
and to lower the level of training. No socio-economic evidence supports any of the decisions. Legal analysis reveals
uncertainties and inaccuracies in the drafting of the texts
which lead to unequal treatment between comparably
structured disciplines. Finally since its entry into force,
none of the elements of technical, legal and ethics of this
reform does justify the application to medical disciplines
as genetics.
