Résumé

Article 3 of the European Convention for the Protection of Human Rights and Fundamental Freedom serves as
a reference on the rights of people detained to healthcare. The Case Law of the European Court allows for the
assessment of the difficulties encountered in providing healthcare to ill people deprived of freedom and who do
not always have access to sufficient care. On which grounds does the Court establish whether or not this article
has been breached? Has there been an evolution over time in its position? These are the questions to which we
strive to answer by studying the different petitions.
